At Talebard ("we," "our," "us"), we respect and protect the privacy of our users. This Privacy Policy explains how we collect, use, and share information when you visit and interact with our website, talebard.com, and our Talebard app for Android (together, the "Site"). By using our Site, you agree to the terms outlined in this Privacy Policy.

Talebard is operated by Apartpay LLC, a company in Florida, USA, which is responsible for your personal information (the "controller").

1. Information We Collect

We collect the following types of information from users of our Site:

a. Personal Information

When you create an account, we collect personal information such as:

• Name
• Email address
• Username and password
• Pictures you choose to upload, for example when you write your own tale

b. Non-Personal Information

We also collect non-personal information about your interaction with the Site, including:

• Browser type and version
• Device type and operating system
• IP address
• Pages visited, time spent on the Site, and other usage statistics

This information helps us improve your experience and the functionality of our services.

c. Analytics

We use Microsoft Clarity, a website analytics tool provided by Microsoft, to help us understand how visitors interact with our Site. Clarity uses cookies and similar technologies to collect information such as your IP address, browsing behavior, device information, and interactions with the Site (including through heatmaps and session recordings) so that we can improve the Site's design and user experience. Clarity is not used on pages made for children or while Kid mode is on (see Children's Privacy below). For more information, please see the Microsoft Clarity FAQ and Microsoft Privacy Statement.

d. Cookies

Our Site uses strictly necessary cookies to operate (see our Cookie Policy), and, only if you consent, advertising cookies to measure and personalize ads. Advertising cookies are never set on pages made for children or while Kid mode is on. You can manage your cookie preferences at any time through the cookie consent banner or your browser settings.

e. The Talebard App

The Talebard app for Android shows the same stories, coloring pages and games as the website. In the app:

• There is no third-party analytics or advertising: Microsoft Clarity, the Google Ads tag and advertising cookies are not part of the app, and the app does not use the advertising ID.
• You sign in through your phone's browser. The app keeps its sign-in on the phone so you stay signed in.
• To work without internet, the app keeps some things on the phone: Kid mode's timer, the stories and coloring books you download, and your coloring. They are removed when you remove them in the app or uninstall it.
• When you write your own tale, you pick pictures with Android's photo picker. The app only receives the pictures you pick, and they are uploaded to create your story. The app does not ask for access to your photo library or camera.

f. Fraud Prevention

To protect families and our service from fraud, such as stolen cards, chargebacks and people creating many accounts to collect free coins, we record:

• The IP address and a random device ID when you sign up and when you buy coins. The device ID is stored in the tb_did cookie (see our Cookie Policy). It is only used for fraud prevention and is never used for advertising.
• A card identifier from Stripe for each purchase. It lets us recognize a card that was used for fraud, without us seeing or storing the card number.

We use this information to stop duplicate accounts and abuse of free coins, to block cards used for fraud, and as evidence if a payment is disputed.

2. How We Use Your Information

We use the information we collect for the following purposes:

• Account Management: To create and manage your account, provide personalized features, and allow you to track your reading and listening activity.
• Story, Image, Audio, and Video Generation: To generate the stories, illustrations, narration, and videos you request, your prompts and related content are sent to the AI providers described below for processing.
• Payments: To process payments for coins and Talebard Plus: through Stripe on the website, and through Google Play in the Android app. Your payment information is securely processed by Stripe or Google, and we do not store your payment details. For app purchases, Google tells us the order number, the product bought and the state of a subscription, which we use to deliver what you bought and to handle refunds.
• Communication: To send essential emails, such as account verification, password reset instructions, important notifications, and service-related updates.
• Security and Fraud Prevention: To keep accounts secure, prevent duplicate accounts and abuse of free coins, block cards used for fraud, and respond to refunds and payment disputes.
• Improvement of Services: To analyze usage patterns and improve the content, features, and overall functionality of the Site.
• Marketing: With your consent, we may send you promotional emails or newsletters about new stories, updates, and offers. You can opt out of marketing communications at any time.

3. How We Share Your Information

We do not sell or rent your personal information to third parties. However, we may share your information in the following circumstances:

• Service Providers: We share information with third-party service providers who process it on our behalf, including: AI content-generation providers (such as OpenAI, Google Gemini/Vertex AI, and Microsoft Azure AI) used to generate story text, images, audio narration, and video; Stripe for payment processing, fraud checks and payment disputes (including the IP address and device ID of a purchase); Google Play for purchases in the Android app (we pass an internal account number with each purchase so it is credited to the right account); Google reCAPTCHA for bot and fraud protection; email service providers for account and transactional messages; Microsoft Clarity for website analytics, heatmaps, and session recordings; and, only if you accept advertising cookies, Google Ads for ad measurement. These providers are required to use your information only as necessary to provide services to us and are bound by confidentiality agreements.
• Legal Compliance: We may disclose your information if required to do so by law, in response to a legal request, or to protect the rights, property, and safety of Talebard, our users, or others.

4. Data Security

We take appropriate measures to protect your personal information from unauthorized access, use, or disclosure. However, please note that no data transmission over the internet or method of electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee its absolute security.

5. Your Choices and Rights

You have the following rights regarding your personal information:

• Access: You can access and update your account information at any time by logging into your account on the Site.
• Opt-Out: You can opt out of receiving marketing emails at any time by clicking the "unsubscribe" link in any promotional email or by contacting us directly.
• Deletion: You can delete your account and its data yourself at any time, on the website or in the app (My Account → Delete account; see how to delete your account), or ask us to do it. After your account is deleted, we keep only:
  • Records of past purchases and subscription payments (date, amount, coins bought, Stripe or Google Play payment references and a card identifier from Stripe), which we need for tax, refunds and payment disputes. They are no longer linked to your name or email.
  • The IP address and device ID of each purchase, until 18 months after the purchase, when we delete them. This covers the time in which a payment can be disputed.
  • Card identifiers of cards that were used for fraud or a disputed payment, so those cards can't be used again.
  • A one-way hash of your email address, if your account received the sign-up bonus, so the bonus can't be claimed twice. A hash can't be turned back into your email address.
• Cookies: You can accept or reject advertising cookies at any time through the cookie consent banner or your browser settings. Rejecting them does not affect your ability to use the Site.

6. Children's Privacy

Talebard is a family app. Accounts are created and managed by an adult (a parent or legal guardian). Children use Talebard through their parent's account, for example in Kid mode, which a parent turns on.

We do not collect personal information from children:

• Children cannot create accounts. Kid mode never asks a child to type their name or anything else about themselves: character names are picked from a list, and there are no uploads, chat, voice recording or camera features for children.
• Kid mode's settings, such as time limits, are entered by the parent.
• Activity such as stories finished, stickers earned or learning progress is stored in the parent's account so that the parent can see it. It is never used for advertising.
• Third-party analytics and advertising tools (Microsoft Clarity and the Google Ads tag) are not used on pages made for children (games, tools, coloring, story players and lessons) or anywhere while Kid mode is on.

Talebard is meant for children to use under a parent's supervision, through the parent's account. Because we do not collect personal information from children, the Children's Online Privacy Protection Act (COPPA) does not require us to ask for parental consent. If we ever offer a feature that collects personal information from a child, we will first get verifiable consent from the parent, as COPPA requires.

Parents can ask us to show or delete their child's activity at any time (see Contact Us below), and deleting the account deletes it as well. If you believe a child has given us personal information, please contact us and we will delete it.

7. If You Live in the EU, EEA or UK

If data protection law in the European Union, the European Economic Area or the United Kingdom (GDPR) applies to you:

• Why we use your information: to provide the Site and your account (our contract with you); with your consent, for marketing emails and advertising cookies; and for our legitimate interests in keeping the Site secure, preventing fraud and abuse, defending against payment disputes, and improving the Site.
• Your rights: you can ask to access, correct or delete your personal information, to restrict or object to how we use it, and to receive it in a portable format. Where we rely on your consent, you can withdraw it at any time.
• Transfers: we and most of our service providers are in the United States, so your information is processed there, with the safeguards the law requires for such transfers.
• How long we keep it: for as long as you have an account. When you delete your account, we delete your personal information, except purchase records (which we keep for tax, refunds and disputes; their IP address and device ID are deleted 18 months after the purchase), identifiers of cards used for fraud, and a one-way hash of your email address, if your account received the sign-up bonus, so the bonus can't be claimed twice.
• Complaints: you can contact us (see Contact Us below), and you also have the right to complain to your local data protection authority.

8. Third-Party Links

Our Site may contain links to third-party websites or services that are not operated by us. We are not responsible for the privacy practices or the content of these third-party sites. We encourage you to review the privacy policies of any third-party sites you visit.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make changes, we will post the updated Privacy Policy on this page and update the "Effective Date" at the top of the policy. We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information.
