Terms and Conditions

Welcome to Talebard! These Terms and Conditions ("Terms") govern your access to and use of our website, talebard.com, our mobile apps and their services (together, the "Site"). By using our Site, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Site.

1. Account Registration

To access certain features of the Site, you may be required to create an account. You must be at least 18 years old (or the age of majority where you live) to create an account. By registering, you agree to:

• Provide accurate and up-to-date information.
• Maintain the confidentiality of your login credentials (username and password).
• Notify us immediately of any unauthorized use of your account.
• Keep only one account. Creating multiple accounts, including to obtain free or bonus coins, is not allowed.

You are responsible for all activities that occur under your account, including purchases made by children or other people using your account or device. We reserve the right to suspend or terminate your account if we suspect any fraudulent or unauthorized activity.

2. Use of the Site

You agree to use the Site for lawful purposes and in accordance with these Terms. You may not use the Site in any way that could damage, disable, or impair its functionality, interfere with other users' enjoyment, or violate any applicable laws. Specifically, you agree not to:

• Upload or transmit harmful content, such as viruses or malware.
• Use the Site to harass, threaten, or harm other users.
• Engage in any activity that may violate the rights of others, including intellectual property rights.
• Use automated means, fake or disposable identities, or other tricks to create accounts or obtain free coins.

3. Purchases, Coins and Payment

The Site allows users to purchase "coins," which can be used to create stories and use other features of the Site. By making a purchase, you agree to the following:

• On the website, payments are processed by our third-party payment processor, Stripe, and you agree to abide by Stripe's terms and privacy policy. In the Android app, purchases are processed by Google Play, and Google Play's terms and refund policies apply to them.
• Coins are digital content and are added to your account immediately after payment. By completing a purchase, you request immediate delivery and acknowledge that, once the coins are delivered, you lose any legal right to withdraw from the purchase (for example, the 14-day right of withdrawal for consumers in the European Union and the United Kingdom).
• Coins give you a license to use features of the Site. They have no cash value, cannot be transferred to another account, and cannot be sold or exchanged for money.
• All purchases are final. Refunds are only given as described in Section 11 or as required by law, and only to the original payment method.
• You are responsible for any taxes or fees that may apply to your purchase.

Free and bonus coins. We may offer free or bonus coins, such as a welcome bonus. These are limited to one per person, have no cash value, and may be changed or ended at any time. We may withhold or remove free or bonus coins that were obtained through multiple accounts, automated sign-ups or other abuse.

Refunds, chargebacks and disputes. If a payment is refunded or reversed, or you dispute it with your bank or card issuer, we will deduct the coins from that purchase from your balance. If you have already spent them, your balance may become negative, and you will need to bring it back above zero before you can use coins again. While a dispute is open, or after repeated refunds or disputes, we may suspend purchases and coin spending on your account. If a dispute is resolved in our favor, we will restore the deducted coins.

Questions about a charge? Please contact us at [email protected] before contacting your bank. Most billing questions, including charges you don't recognize, can be resolved quickly.

Talebard Plus subscription. Talebard Plus is an optional subscription. The price, billing period and what is included are shown before you subscribe. By subscribing, you agree to the following:

• Automatic renewal. Your subscription renews automatically at the end of each billing period (monthly or yearly) and you are charged the then-current price until you cancel. We will tell you in advance about any price change, and you can cancel before it takes effect.
• Canceling. You can cancel at any time: on the website under Manage subscription on the coins page, or, if you subscribed in the Android app, in Google Play. Canceling stops future renewals; Talebard Plus stays active until the end of the period you already paid for.
• Monthly coins. Talebard Plus adds coins to your account every month, also on a yearly plan. Unused Plus coins carry over for one month: when new monthly coins arrive, unused Plus coins beyond one month's worth expire. Coins you buy separately do not expire.
• Downloads. Talebard Plus includes unlimited downloads for offline use in the Android app. Without it, you can use a limited number of downloads. When your subscription ends, downloads beyond that limit stay on your device but are hidden until you subscribe again; you can delete them at any time.
• Refunds. Subscription payments are not refunded for partial periods, except as required by law or as described in Section 11. If a subscription payment is refunded or disputed, the coins it added are deducted as described below.

4. Content Usage and License

By using the Site, you gain access to content such as stories, audio, and other materials ("Content"). You agree to the following terms regarding the Content:

• You are granted a limited, non-exclusive, non-transferable license to access and use the Content for personal, non-commercial use only.
• You may not copy, distribute, modify, or create derivative works of the Content without prior written consent from us.
• We retain all intellectual property rights to the Content and any materials related to the Site.

5. Responsibility for Content Review

You are solely responsible for reviewing the Content provided on the Site before sharing or presenting it, especially if you plan to share it with minors. We do not assume any responsibility for how the Content is used or interpreted, nor do we monitor how it is shared. It is your responsibility to ensure that the Content is appropriate for the intended audience, particularly if minors are involved. By using the Site, you agree to take full responsibility for the use of the Content and acknowledge that you will not hold Talebard or its affiliates liable for any issues arising from your sharing or presentation of the Content.

6. Children

Talebard is made for families, but accounts are for adults. Children may use Talebard only through the account of a parent or legal guardian (for example, in kid mode or a child profile) and under that adult's supervision. Children may not create their own accounts or make purchases.

The parent or guardian who holds the account is responsible for how children use Talebard, including any purchases or coin spending on the account. To learn how we handle information about children, please see our Privacy Policy.

7. Account Termination

We reserve the right to suspend or terminate your account and access to the Site at any time for any reason, including but not limited to violations of these Terms, fraud, abuse of free coins, or unlawful behavior. Upon termination, your right to use the Site will immediately cease, and any outstanding payments or fees will remain due. Coins left in an account that is terminated for a violation of these Terms, or that you delete yourself, are lost and cannot be refunded.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information when you use the Site.

9. Disclaimers

The Site and its Content are provided on an "as-is" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of the Content. We do not guarantee that the Site will be error-free or uninterrupted. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

10. Limitation of Liability

In no event shall we or our affiliates be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site, including but not limited to lost profits, data loss, or business interruption. Our total liability to you for any claim arising out of or relating to these Terms or the use of the Site shall not exceed the amount you paid for access to the Site or services during the six (6) months preceding the claim.

11. Story Quality and Coin Refunds

Stories created using the Site may vary in quality based on various factors, and while we strive to offer a valuable experience, we do not guarantee that every generated story will meet your expectations. Coins used to create stories are not refunded because a story does not meet your expectations.

If a story or other feature fails because of a technical problem on our side, we will return the coins spent on it to your balance. This often happens automatically; if it doesn't, please contact us. Apart from this, and except as required by law, coin purchases are final and are not refunded.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Florida, USA, without regard to its conflict of law principles. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts located within Florida, USA, and you consent to the jurisdiction of such courts.

13. Modifications to These Terms

We reserve the right to modify or update these Terms at any time. When we make changes, we will post the updated Terms on this page and update the "Effective Date" at the top. You are responsible for reviewing these Terms periodically to stay informed about any changes. Your continued use of the Site after changes are made constitutes your acceptance of the revised Terms.
